Terms of Use

Please read these Terms of Use carefully before using the Bike Summit mobile application. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use the app.

1. Acceptance of Terms

These Terms of Use constitute a legally binding agreement between you and Bike Summit governing your access to and use of the application and related services.

2. Eligibility

You must be at least 16 years of age to use Bike Summit. By using the app you confirm that you meet this requirement and that the information you provide is accurate.

3. Your Account

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at contact@bikesummit.ch if you suspect unauthorised access.

4. Acceptable Use

You agree not to:

• Use the app for any unlawful purpose or in violation of any regulations.
• Upload, share, or otherwise make available any objectionable, abusive, hateful, harassing, sexually explicit, violent, fraudulent, or unlawful content.
• Upload false, misleading, manipulated, or fraudulent activity data.
• Cheat in any form, including by falsifying GPS data, altering photos, submitting activity you did not complete, using multiple accounts to gain an unfair advantage, or manipulating rankings, points, badges, or team results.
• Attempt to reverse-engineer, hack, or disrupt the app or its infrastructure.
• Harass, abuse, or harm other users.
• Use automated means to access or scrape the service without our prior consent.

5. Moderation, Abuse, and Cheating

Bike Summit has zero tolerance for objectionable content, abusive behaviour, and cheating. We may investigate reports, remove or hide content, restrict features, reset rankings or rewards, suspend accounts, or permanently ban users when we reasonably believe that content or conduct violates these Terms or undermines the integrity or safety of the service.

Enforcement may occur without prior notice where necessary to protect users, the community, or the platform. Repeated or serious violations may result in permanent loss of access.

6. Intellectual Property

All content, trademarks, logos, and software in Bike Summit are the property of Bike Summit or its licensors. You are granted a limited, non-exclusive, non-transferable licence to use the app for personal, non-commercial purposes only.

7. User-Generated Content

You retain ownership of any content you submit (e.g., activity records). By submitting content, you grant Bike Summit a worldwide, royalty-free licence to use, store, and display that content solely for the purpose of providing the service.

8. Disclaimer of Warranties

The app is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or free of viruses. Cycling is an outdoor activity with inherent risks; Bike Summit is not responsible for any injury, loss, or damage arising from your use of the app.

9. Limitation of Liability

To the fullest extent permitted by law, Bike Summit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the app, even if advised of the possibility of such damages.

10. Termination

We reserve the right to suspend, restrict, or permanently terminate your account at any time if you violate these terms, post objectionable content, engage in abusive conduct, or cheat. You may delete your account at any time by contacting us.

11. Governing Law

These terms are governed by the laws of Switzerland. Any disputes shall be subject to the exclusive jurisdiction of the courts of Switzerland.

12. Changes to These Terms

We may revise these terms at any time. We will notify you of material changes via the app or email. Continued use of the app after changes become effective constitutes your acceptance of the revised terms.
